1. Agreement to Terms

By accessing or using The Disposable, including our iOS application (SCENE) and web application at scenedisposable.com (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

The Disposable is a disposable camera application for events. Event hosts create events and choose a photo filter style. Guests join events by scanning a QR code or entering an event code. Guests capture photos using the in-app camera, which are stored locally on the device and uploaded to a shared event gallery. All photos remain locked and hidden until a host-set reveal time, after which all event participants can view and download the photos.

The Service is provided via a web application accessible at scenedisposable.com and a native iOS application available on the App Store.

3. User Accounts and Sessions

Guest users participate in events through anonymous device-based sessions. No account creation is required to capture photos or participate in events. Event hosts may optionally sign in using Apple Sign-In or Google Sign-In to access additional host features.

You are responsible for maintaining the security of your device and any session associated with it. You must not impersonate other individuals or use the Service for any unauthorized purpose.

4. User Content

You retain full ownership of all photos you capture using the Service (“User Content”). By uploading photos to the Service, you grant The Disposable a limited, non-exclusive, royalty-free license to store, process, display, and distribute your photos solely for the purpose of operating the Service — specifically, displaying photos in the event gallery and enabling other event participants to view and download them. This license terminates when you delete your photos or when the event host deletes the event.

You represent and warrant that you have the right to share any content you upload and that your content does not violate any third party's rights. You must not upload content that is:

  • Illegal, obscene, or defamatory
  • Threatening, harassing, or hateful
  • Discriminatory or harmful to any person or group
  • In violation of any person's privacy or intellectual property rights

5. Event Host Responsibilities

Event hosts are responsible for their events and the content captured within them. Hosts set the reveal time, photo filter, and participation limits for their events. Hosts can delete their events and all associated photos at any time. Hosts should make reasonable efforts to inform guests that photos are being captured and will be shared with other event participants after the reveal time.

6. Prohibited Uses

You agree not to use the Service to:

  • Engage in any illegal activity or violate any applicable laws
  • Upload or share illegal, obscene, harmful, or abusive content
  • Attempt to access other users' data or sessions without authorization
  • Interfere with, disrupt, or overload the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools, bots, or scrapers to access the Service
  • Attempt to circumvent the photo reveal mechanism or any other security features
  • Use the Service to distribute spam, malware, or phishing content

7. Intellectual Property

The Disposable name, logo, design, and all associated branding are the property of The Disposable. The Service software, user interface design, and underlying technology are our intellectual property or licensed to us. You may not copy, modify, distribute, sell, or lease any part of the Service or its branding without our prior written consent. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Photos stored locally on your device may be lost if your device is damaged, reset, or if the app is uninstalled before photos are uploaded. We do not guarantee permanent storage of photos on our servers. Event hosts may delete events and all associated photos at any time.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Disposable and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of photos, loss of profits, or damage to reputation, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the total amount you have paid to us for use of the Service in the twelve (12) months preceding the claim, or (b) fifty US dollars (US$50).

10. Indemnification

You agree to indemnify, defend, and hold harmless The Disposable, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any third party's rights.

11. In-App Purchases

The Disposable offers optional in-app purchases that allow event hosts to increase the participant capacity of their events. These purchases are one-time, consumable transactions processed through Apple's App Store or Google Play Store.

All purchases are subject to the payment terms and policies of the respective app store. We do not collect or store any payment card information. Pricing is displayed in the app before purchase, and you will be charged through your app store account.

Refunds for in-app purchases are handled by Apple or Google in accordance with their respective refund policies. To request a refund, please contact Apple Support or Google Play Support. We are unable to process refunds directly.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Data deletion following termination is handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the competent courts of Vietnam.
